§ 1 Scope

These General Terms and Conditions apply to all orders placed through the online shop "VisionaireX", accessible at www.visionairex.de.

Sales are conducted as a sole proprietor (small business).

§ 2 Subject Matter of the Contract

The subject of the contract is the sale of print-on-demand products, in particular:

  • Phone cases
    • from fixed design collections (not personalized)
    • as well as personalized items made to customer specifications
  • Posters, which are delivered exclusively in connection with personalized phone cases
    • the poster features the same print as the personalized phone case
    • a separate purchase of posters is not possible

All products offered are produced only after receipt of the order and are not stocked items.

§ 3 Contract Formation

The presentation of products in the online shop does not constitute a legally binding offer.

By submitting an order, the customer makes a binding offer to conclude a purchase contract.

The contract is concluded as soon as the customer receives an order confirmation by email.

§ 4 Prices and Payment Terms

All prices listed are final prices.

In accordance with § 19 UStG (small business regulation), no value-added tax is charged.

Any applicable shipping costs are shown separately during the ordering process.

The available payment methods are displayed in the online shop.

§ 5 Delivery and Shipping

Products are manufactured after receipt of the order using the print-on-demand method by an external production and shipping service provider.

Delivery times (including production and shipping):

  • Germany & European Union: Typically 5–8 business days
  • International deliveries (worldwide): Typically 8–18 business days

The stated delivery times are approximate values. In individual cases, delays may occur due to production workload, shipping service providers, customs clearance, or international transport routes, over which the seller has no influence.

§ 6 Right of Withdrawal

a) Non-personalized Products (Design Collections)

For non-personalized phone cases from fixed design collections, a 14-day right of withdrawal applies.

The customer has the right to withdraw from the contract within 14 days without giving any reason.

Conditions for return:

  • The goods are unused
  • The goods are in their original condition
  • The return is made within the deadline

The customer bears the costs of return shipping.

b) Personalized Products

The right of withdrawal does not apply to personalized products manufactured according to individual customer specifications (§ 312g para. 2 No. 1 BGB).

This applies in particular to:

  • Personalized phone cases
  • Posters created and included as part of a personalized order

Returns due to dissatisfaction or incorrect personalization by the customer are excluded.

§ 7 Defect Liability and Complaints

Regardless of the right of withdrawal, statutory warranty rights apply.

Complaints are accepted for:

  • Production defects
  • Transport damage
  • Incorrectly delivered items

Complaints must be reported within 7 days of receiving the goods by email, accompanied by clear photographic evidence.

After review, the seller will provide a replacement delivery or refund at the seller's discretion.

§ 8 Liability

The seller is fully liable in cases of intent and gross negligence.

In cases of slight negligence, the seller is only liable for the breach of essential contractual obligations (cardinal obligations) and limited to the foreseeable, contract-typical damage.

Liability for delays or service disruptions caused by external production or shipping service providers is excluded, unless intentional or grossly negligent conduct is involved.

§ 9 Retention of Title

The goods remain the property of the seller until full payment has been received.

§ 10 Intellectual Property

All designs, motifs, texts, and content displayed in the online shop are protected by copyright.

Reproduction, reuse, or commercial use beyond private use is not permitted without the express written consent of the seller.

§ 11 Applicable Law

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.

§ 12 Final Provisions

Should any provision of these Terms and Conditions be or become invalid in whole or in part, the validity of the remaining provisions shall not be affected.
